These Terms and Conditions ("Terms") govern your access to and use of the website www.livguard.com, related microsites, applications, and services (collectively referred to as the "Platform").

By accessing, browsing, registering, or using the Platform in any manner, you ("User", "you" or "your") agree to be bound by these Terms. If you do not accept these Terms, please refrain from using the Platform.

This is an electronic record in the form of a User Agreement formed under the statutes pertaining to electronic documents / records in India. This user agreement does not require any physical, electronic or digital signature.

• "Platform": The website, applications, and digital touchpoints operated by Livguard.

• "Products": Energy storage solutions, inverters, solar products, Inverter battery, EV batteries, and other goods manufactured or marketed by Livguard.

• "Services": Any after-sales support, warranty, installation, and maintenance services provided by the Livguard or authorized service partners.

• "Content": All information, visuals, logos, trademarks, product descriptions, documents, and media made available through the Platform.

• "User Data": Any personal or non-personal information voluntarily shared by a User while accessing the Platform.

• "Force Majeure Event": shall mean any event due to any cause beyond the reasonable control of Livguard including, without limitation, acts of God, fire, flood, earthquake, epidemic, explosion, civil commotion, strikes, lockout, of any kind, riots, insurrection, hostilities whether war be declared or not, acts of government, governmental orders or restrictions, unavailability or breakdown of any communication system or transport facility, sabotage, breakdown and/or hacking of the Website and/or its features, software or contents provided for availing the services listed on the Website, such that it is impossible to perform the obligations under this User Agreement, or any other cause or circumstances beyond the control of Livguard which prevents timely fulfilment of obligation of Livguard hereunder.

• You must be at least 18 years old or accessing the Platform under the supervision of your parents/guardians.

• By using the Platform, you confirm that you are legally competent to enter into a binding contract under applicable laws.

• You agree to use the Platform only for lawful purposes.

• You shall not misuse, copy, duplicate, sell, resell, or exploit any portion of the Platform or its Content without Livguard's prior written consent.

• In the event You come across any abuse or violation of this User Agreement or if You become aware of any objectionable content on the Website, please report to the Customer support.

• Any unauthorized use may result into termination of access and be followed by suitable legal action.

• Unless otherwise specified, the Services provided on the Website are solely available within the geographical boundaries of the Republic of India.

• You agree that all trademarks, logos, product names, designs, and Content on the Platform are the exclusive property of Livguard or its licensors.

• Nothing in these Terms shall be construed as granting you any license or right to use intellectual property without prior authorization.

You agree that:

• Livguard strives to ensure that all product information, specifications, and pricing displayed on the Platform are accurate. However, inadvertent errors or omissions may occur.

• Prices, offers, and availability are subject to change without prior notice.

• Images and product visuals are for representation only; actual products may vary.

You agree that:

• By placing an order, you agree to purchase products subject to these Terms and conditions.

• All payments must be made through the authorized payment gateways provided on the Platform.

• Livguard reserves the right to cancel any order on its sole discretion including but not limited to the incorrect pricing, stock unavailability, or suspected fraudulent activity.

You agree that:

• Delivery timelines provided are estimates and subject to various factors beyond Livguard's control and Force Majeure events.

• Risk of loss passes to you upon delivery of the product.

• Certain products may require professional installation, which will be arranged through authorized service providers.

You agree that:

• Products are covered under the standard warranty terms communicated in writing at the time of purchase.

• Warranty claims must be accompanied by valid proof of purchase.

• Damage due to misuse, negligence, unauthorized repair, deep discharge or modification is not covered.

• Users may be required to create an account to access certain features.

• You are responsible for maintaining the confidentiality of your account credentials and Livguard will not be held liable for any of your mistakes.

• Livguard is not liable for losses resulting from unauthorized use of your account.

• By using the Platform, you consent to Livguard's collection and use of your information in accordance with its Privacy Policy.

• You are responsible for ensuring the accuracy of the data you provide.

• Livguard shall not be liable for any incorrect, incomplete, or outdated information shared by Users.

• The Platform may contain links to third-party websites or services.

• Livguard does not endorse or assume responsibility for the content, accuracy, or practices of such external websites.

• To the maximum extent permitted by law, Livguard shall not be liable for any indirect, incidental, or consequential damages arising out of the use of its Platform, products, or services.

• Livguard's total liability shall not exceed the amount paid by the User for the specific product or service.

You agree to indemnify, defend, and hold harmless Livguard, its affiliates, officers, employees, and service partners from any claims, damages, or expenses arising from your misuse of the Platform, violation of these Terms, or infringement of intellectual property rights.

• Livguard reserves the right to suspend or terminate access to the Platform without prior notice in case of breach of these Terms.

• Upon termination, all rights granted to you shall be ceased immediately.

• These Terms shall be governed by and construed in accordance with the laws of India.

• Any disputes arising out of the Terms & Conditions shall be subject to the Arbitration and Conciliation Act, 1996. The proceedings of the arbitration shall be conducted in English language. The place and venue of arbitration shall be in New Delhi.

Livguard reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform, and continued use shall be deemed acceptance of the revised Terms.
